1. Introduction

Welcome to Bestieku.id, the official website operated by PT. Teman Hidup Maya (“the Company”, “we”, “us”, or “Bestieku”).

By accessing or using this website, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions (“Terms”).

If you do not agree with any part of these Terms, please discontinue your use of this website immediately.

2. Definitions

In this document, :

a. “Bestieku” means PT. Teman Hidup Maya, a limited liability company duly established and existing under the laws of the Republic of Indonesia, conducting business activities in Portal Web and/or Digital Platform for Commercial Purpose.
b. “Site” means the website www.bestieku.id, owned and operated by Bestieku, which may be accessed via desktop platforms and/or mobile applications operating on Android and/or iOS.
c. “User” means any individual or legal entity that accesses or uses the Bestieku.id website.
d. “Services” means all content, information, features, functions, and services made available by Bestieku through the Bestieku.id website.
e. “Content” means all materials available on the Site, including but not limited to text, images, videos, graphics, designs, logos, software, and other materials.
f. “Personal Data” means any data, whether true or not, relating to an identified or identifiable individual, either directly or indirectly, from such data alone or from such data combined with other information that is in the possession of, or is likely to come into the possession of, Bestieku. Personal Data includes, without limitation, names, identification numbers, and contact information.

3. Use of the Site

3.1 The User represents and warrants that the User is at least 18 (eighteen) years of age or is legally married, and is not under custody or guardianship, and that the User has the legal capacity, authority, and right to enter into and be bound by these User Terms.

In the event that the User does not meet the foregoing requirements but nevertheless accesses or uses the Site, the Services available on the Site, any third-party content available on the Site, any offers on the Site, or any payment methods available on the Site, the User represents and warrants that such access, use, or other activities on the Site have been approved by the User’s parent, legal guardian, or curator.

The User expressly waives any rights under applicable laws and regulations to cancel, revoke, or withdraw any and all consents granted under these User Terms once the User is deemed legally competent and of legal age.

3.2 The User agrees to use the Site solely for lawful purposes and in accordance with the applicable laws and regulations of the Republic of Indonesia.

3.3 The User is prohibited from using the Site to:

• a. upload, use, or distribute any words, images, videos, or other content that is unlawful and/or infringes the intellectual property rights of any party, contains elements of ethnicity, religion, race, or inter-group issues (SARA), discrimination, harassment, humiliation, vulgarity, threats, advertising, or promotion of websites other than the Bestieku Site, or any other content deemed inconsistent with social norms, values, or policies as determined solely by Bestieku;
• b. upload or transmit viruses, malware, or other harmful code; or
• c. gain unauthorized access to systems, attempt hacking, or collect data of other users without authorization.

3.4 The User shall be personally responsible for any infringement of intellectual property rights arising from the User’s content on the Site.

3.5 The User agrees not to use and/or access the Site, directly or indirectly, in whole or in part, using viruses, software, or other technologies that may weaken, damage, disrupt, interfere with, limit, and/or take over the functionality and integrity of the software or hardware systems, networks, and/or data of the Site.

3.6 Bestieku does not charge any registration fees to Users.

3.7 The User understands that one (1) phone number may only be used to register one (1) User account, except for Users who previously registered multiple accounts using the same phone number.

3.8 The User shall be personally responsible for maintaining the confidentiality of the User’s account and password and for all activities conducted under the User’s account.

3.9 Bestieku, without prior notice to the User, has the authority to take any necessary actions in respect of any suspected or actual violation of these Terms of Use and/or applicable laws, including suspension and/or deletion of the User’s account.

3.10 Bestieku will never request the User’s username, password, SMS verification code, or OTP code for any reason. Accordingly, Bestieku urges Users not to disclose such information or any other important data to any party claiming to represent Bestieku or to any other party whose security cannot be guaranteed.

3.11 The User agrees to ensure that the User logs out of the account at the end of each session and to notify Bestieku of any unauthorized use of the User’s password or account.

3.12 The User hereby acknowledges and agrees that Bestieku shall not be responsible for any losses or issues arising from misuse of the User’s account due to the User’s negligence, including but not limited to approving and/or providing account access codes sent by Bestieku via notification messages to other parties through the User’s device, lending the account to other parties, accessing links provided by third parties, disclosing or displaying verification codes (OTP), passwords, or email addresses to other parties, or any other negligence by the User resulting in losses or issues with the User’s account.

3.13 The User understands and agrees that, in order to use one-time password (OTP) security features, the relevant telecommunications service providers may from time to time charge fees to the User in certain amounts, plus Value Added Tax (VAT), in accordance with applicable Indonesian tax laws and regulations. Such fees may vary depending on the policies of the telecommunications service providers.

3.14 The User represents and warrants that all inputs provided into the Bestieku system, including text, questions, or other content (“User Content”), do not violate applicable laws, intellectual property rights, privacy rights, or the rights of any third party.

3.15 The User is prohibited from entering, uploading, or transmitting content containing sensitive data, including but not limited to health data, financial information, biometric data, data of minors, or personal data of other parties without a lawful basis.

3.16 Bestieku reserves the right to remove, block, or restrict User Content deemed to be in violation of these Terms, without any obligation to provide reasons.

3.17 To the extent permitted by applicable laws, the User grants Bestieku a non-exclusive license to use User Content in anonymized and aggregated form for the purposes of service improvement, feature development, security audits, and other non-commercial analytical purposes.

3.18 Bestieku reserves the right, without prior notice, to suspend, restrict, or terminate the User’s access to part or all of the Services if:

• a. A violation of these Terms of Use is identified;
• b. Suspicious activities, fraud, abuse of services, or system attacks are detected
• c. Required by law enforcement authorities or competent government authorities; or
• d. Necessary to maintain system security, protect other users, or ensure legal compliance;

3.19 In the event of account termination, Bestieku shall not be obligated to store, return, or provide copies of any data or content to the User, except as required by

4. Artificial Intelligence (AI)-Based Services

4.1 Bestieku's Services utilize artificial intelligence (AI) technology that generates content automatically based on User input. The User acknowledges that AI-generated outputs may contain inaccuracies, errors, biases, or content that does not fully meet the User's expectations.

4.2 This Service is provided for entertainment, light companionship, and general support purposes only. It is not a psychological, medical, legal, financial, or any other form of professional consulting service.

4.3 Bestieku does not warrant that AI outputs are suitable for making important decisions. For specific needs, including but not limited to emergencies, mental health issues, violence, or legal matters, the User must seek assistance from qualified professionals.

4.4 By using this Service, the User agrees that Bestieku shall not be held liable for any decisions, actions, or losses arising from the use of or reliance on AI-generated outputs.

5. Intellectual Property Rights

5.1 All content, trademarks, logos, artwork, illustrations, writings, and visual elements displayed on this Site are the property of Bestieku or third parties who have granted relevant licenses.

5.2 Users are prohibited from copying, reproducing, distributing, or using any such materials without the prior written consent of Bestieku.

6. Links to Third-Party Sites

6.1 This website may contain links to third-party websites that are not operated by Bestieku.

6.2 We are not responsible for the content, privacy policies, or practices of those third-party sites. Accessing and using such sites or links is solely at the User’s own risk.

7. Limitation of Liability

1. Bestieku does not warrant that the website will always be available, error-free, or secure.

2. Under no circumstances shall Bestieku be held liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use this website.

8. Data Retention and Deletion

8.1 Bestieku may store user data and interaction history for the period necessary to provide the service, improve system quality, fulfill legal obligations, or resolve disputes.

8.2 Users may request account deletion in accordance with Bestieku's established procedures. However, the User understands that:

• a. Certain data may be retained for legal compliance purposes; and
• b. Anonymized data cannot be deleted as it is no longer considered Personal Data.

8.3 Bestieku is not obligated to delete or return User data if the account is terminated due to a breach of these Terms.

9. Law Enforcement

9.1 Bestieku may process, withhold, or provide access to certain information to law enforcement agencies when required by applicable law.

9.2 Bestieku reserves the right to remove or restrict access to any content suspected of violating the law, breaching these Terms of Use, or potentially endangering other Users, without prior notice.

10. Force Majeure

Bestieku shall not be liable for any delay or failure in service provision caused by circumstances beyond its reasonable control, including but not limited to natural disasters, power outages, third-party system failures, war, civil unrest, government orders, cyberattacks, or any other events constituting force majeure under Indonesian law.

11. Indemnification and Release

11.1 The User agrees to indemnify, defend, and hold harmless Bestieku (including but not limited to its Parent Company, affiliates, directors, commissioners, shareholders, and employees) from any claims, liabilities, damages, or expenses (including reasonable legal fees) brought by a third party arising from the User's breach of this Agreement, improper use of the Bestieku Service, and/or the User's violation of any law or the rights of a third party.

11.2 The User acknowledges liability for any losses incurred by Bestieku resulting from a breach committed by the User.

12. Service and Terms Modifications

We reserve the right to update, modify, or revise the website content and these Terms at any time without prior notice.

Continued use of the website following any such updates constitutes your acceptance of the revised Terms.

13. Governing Law and DIspute Resolutions

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Indonesia, including Law Number 27 of 2022 concerning Personal Data Protection. The User agrees that any legal action or dispute arising from, related to, or in any way connected with the site and/or these Terms of Use shall be resolved exclusively within the jurisdiction of the courts of the Republic of Indonesia.
